Spouse Visa UK and Indefinite Leave to Remain
Spouse visa UK allows the spouse of a UK citizen or permanent resident to come to the United Kingdom to settle. This visa allows you to work in the UK. If you have been together for less than 4 years, you are granted the spouse visa UK for a probationary period of 2 years. After 2 years and you are still married and living together you can apply for indefinite leave to remain UK. if you have been together more than 4 years outside the UK and you have passed the life in the UK test, you are eligible to apply for indefinite leave to enter in the UK without having complete the spouse visa probationary period.
To qualify for the spouse visa UK you must have the following requirements:
• Both partners should be 21 years and over
• The UK citizen must have met their spouse
• You must intend to live together in order to obtain the spouse visa
• You must possess sufficient funds to for your living expenses and your spouse and any dependants without claiming for public funds.
• Should have suitable and available accommodation for the spouse and dependant children
If you have entry clearance for 6 months or less you cannot change status to spouse visa and children of the marriage who are under 18 years old are allowed entry to the UK as dependants and can make their application at the same time as the main applicant.
Indefinite leave to remain UK allows you to live in the United Kingdom indefinitely. If you have been living in the UK under a visa category which leads to settlement, you may apply for indefinite leave to remain depending on the term of the visa. There is no time limit with this visa and you should not spend more than 2 years outside of the United Kingdom. You may also become an eligible British naturalization to the UK if you meet the requirements for citizenship.
A UK resident with indefinite leave to remain should consider the UK as their home and if the individuals only spend short periods of time in the UK, this may lead to losing the ILR status. Before ILR is granted you will have to show that you have sufficient knowledge of English or welsh or Scottish Gaelic. You should not have been dependant upon public funds during the time in which you had limited leave to remain UK. You have no immigration restrictions upon the type of business or work you are undertaking.
