Australian Spouse Visa and Living in Australia

Australian spouse visa is for those who are married to or are in a de facto relationship with an Australian citizen, an eligible New Zealand citizen or permanent resident in Australia. Your partner will need to sponsor you for two years after which you become eligible for a permanent residence. This visa allow you to enter and remain in Australia on a temporary visa and on a permanent visa if after the waiting period , your relationship still exists and you are still eligible for the visa.

Australian spouse visa allows you to work, study in Australia, but you will not have access to government funding for tertiary study and enroll in Australia’s medical benefits expenses and hospital care scheme. After 2 years you can remain permanently in Australia with your partner, receive certain social security benefits and apply for Australian citizenship. To be eligible for an Australian spouse visa you must prove that your relationship with your partner is genuine and continuing. You will have to show that you live with your spouse on a permanent basis, need to pass certain health and character tests. Both you and your spouse should be at 18 years old at the time of application.

If you are not legally married, you can still apply for the spouse visa, but you must be in a relationship for 12 months. You can have the waiting period waived at the time of application if you satisfy that you have been in a relationship or you have been married to your partner for five years or longer when you submitted the application.
