Indefinite Leave to Remain UK and Tier 4 Student Visa

Indefinite leave to remain also known as permanent residence give you the right to live and work in the UK without any time limit. It is applied by people who have lived in the UK for a certain length of time and given permission to settle indefinitely. Dependants who are under 18 years of the applicant can also apply for ILR in line with the main applicant.

Depending on your visa category you could qualify for an indefinite leave to remain UK in a number of ways which include:

• Tier 1 category by spending a continuous period of 5 years in the UK.

• Tier 2 general by spending a continuous period of 5 years in the UK.

• Marriage/unmarried partner/civil partner by spending a continuous period of 2 years in the UK

• Ancestry visa by spending 5 continuous years in the UK

• EEA citizen by spending a period of 5 years exercising EC treaty rights in the UK.

• Lawful stay on any basis by spending a continuous 10 years in the UK

• Unlawful stay by spending a continuous period of 14 years in the UK

Tier 4 student visa allows international student to study in the United Kingdom in a full-time course of more than 6 months. It gives international student the opportunity to gain recognized qualification from government approved universities across UK. Tier 4 is granted for the duration of the course that will be studied in the UK. For courses that are degree level or above the applicant of an indefinite leave to remain UK will be able to stay in the UK for up to 4 years. Under the new UK student visa, international students have permission to commence part time work up to 20 hours per week and full-time during holidays.

If the applicant requires more time to study in the UK then their tier 4 student visa may be extended. The student will need to have sufficient funds to pay for the course and that will support themselves in their entire stay in the UK, have a proven track record in studying before coming to the UK, have recognized qualification equivalent to national qualification framework in the UK education system and produce documents that was used to obtain an offer from the educational institutional sponsoring as well as gaining 40 points. The points are awarded to visa letter from a UK education provider 30 point and 10 points for having sufficient funds to cover course fees and living costs.
