Why a Real Estate Expert Witness Matters

A person embroiled in a legal issue may wonder why they would need to call in a real estate expert witness and whether this type of professional really matters in the final outcome of a trial. In short, the answer is yes, it does matter, and having the right real estate expert may make the difference between winning and losing a case. Before skipping the addition of an expert witness to a legal team, a person should first take a look at how and why these professionals have become an integral part of real estate legal proceedings.

In many cases, an expert witness's services are retained by an attorney. The reason for this is that the attorney may have a solid knowledge of real estate law, but will most commonly not have a full understanding of the construction process or local standards of care. Where the expert witness can help is by investigating a specific problem and being able to clearly describe all of the relevant aspects of the issue to the attorney, thus providing a more thorough understanding of the case. Expert witnesses almost unanimously come with a long background in construction and will usually have a very detailed knowledge base of even the smallest aspects of many different types of building projects. Their expertise will help the attorney formulate the strongest case possible for their client.

The other side of an expert witness's services is found during a trial setting. Because a judge and jury may have very limited understanding of the complex technical side of construction, the expert witness's role is to provide testimony on a level where it can be understood by those that will make the final decisions in the case. This type of focused and clear testimony is an extremely important asset as simply providing the technical facts will often have the negative effect of not being understood by the judge or jury. The best expert witnesses will have extensive history in working in the court setting and should be able to provide a list of previous cases where they have delivered testimony that helped to gain a decision for the attorney and their client.
