US Citizenship and Immigration Services and EB5 Green Card

US citizenship and immigration services USCIS was formerly a part of immigration and naturalization service which was divided into several components of department of homeland security DHS. USCIS is responsible for the administration of immigration and naturalization adjudication functions and establishing immigration service policies and priorities. The USCIS enforces laws providing for selective immigration and control entry of tourists and business travelers to citizens and non-citizens. It inspects and admits at land, sea and air ports of entry, administering benefits such as naturalization and permanent resident status green cards, petitions for relatives and orphans and employment authorization documents.

Eb5 green card allows a person and his or her family members to get an EB 5 investor green card by investing a certain amount of money in the US and creating 10 US jobs. The minimum amount of money to invest is $500,000 if one invests in a rural or high unemployment area.

Job creation requirements:

Create or preserve at least 10 full-time jobs for qualifying US workers within two years or under certain circumstances, within a reasonable time of the investor’s admission to the US as a conditional permanent residence.

Create or preserve either direct or indirect jobs- direct jobs are actual identifiable jobs for qualified employees located within the commercial enterprise.

Indirect jobs are those shown to have been created collaterally or as a result of capital invested in a commercial enterprise affiliated with a regional center.

To encourage immigration through eb5 green card, the program sets aside 3,000 green cards each year for foreign investor who invests in designated regional centers. The regional center program does not require the company in which the investor put his or her money to itself employ 10 workers, instead it is enough if 10 or more jobs will be created directly or indirectly. This program differs from regular EB 5 provisions in that it permits private and governmental agencies to be certified as regional centers if they meet certain criteria which make many foreign investors prefer investing in a regional center rather than creating their own company.
