K1 Visa and US citizenship and Immigration Services
K1 visa is a non-immigrant visa which allows entry for your fiancee into the United States for a period of 90 days, during which you are supposed to marry or the fiancee is required to depart the United States. This visa allows the couple to live together in the U.S and the fiancee to experience what the day to day life will really be like before marriage. K1 visa has a shorter waiting period compared to the other marriage based immigration visa, it allows you to apply for a work permit and engage in employment in United States and you are also allowed to apply for K2 dependant visa for your children to reside in the U.S as long as they are named in the visa.
If you are a U.S citizen who wants to bring your fiancee to marry in the U.S, you may apply for K1 visa. Both you and your fiancee must be free to marry and that any previous marriages have ended through divorce, annulment or death. You must also have met with your fiancee in person within the last 2 years before filing for the visa. This requirement can be waived only if meeting your fiancee in person would violate long established customs or create extreme hardship for you.
Once you are married you are required to file for adjustment of status for your fiancee to legally remain in the United States. Permanent residency takes between 1-2 years and it is important to file for it before the visa expires, otherwise you will be out of status. If you want to travel outside before permanent resident status is granted, an employment authorization document must be filed.
