Patent Filing in the United States- First Filing

By Jaggy Subscribe to RSS | April 5th 2012 | Views:

One is always advised to get a special knowledge or idea patented. These idea or discoveries can be related with any odd thing. It just has to be something worth or innovative. Now, how patent filing has to be done is the question.

Time and tide doesn’t wait for any person on this earth. So one has to be quite brisk and get the idea patented before anybody else does or discovers. This is the initial step which indeed is the most important. No one would like someone else gaining from the idea that he/she discovered earlier.

Before proceeding to anything else, the task at hand is to furnish the application for the patent. It does not consume much time and will take in just about an hour if the person applying has adequate knowledge of what he/she is applying for. This lands the applicant to the initial gates for obtaining the patent i.e., if properly filed and duly accepted by the U.S. body for patents (United States Patent and Trademark Office-USPTO)

Self- application is always cheaper in case of simple registrations. Unless the patent is related with something big and complex it would not be advisable to consult a patent agent or a lawyer. These professionals charge lots and lots of money. A bit of self-labor can hence save quite a large amount of money.

If the patent application is duly and properly filled, attested, completed and attached with the other requirements, and it has been accepted, then it give the following dividends to reap-

• Once the patent is registered for a particular idea or invention, nobody can get the same thing patented for at least a year. So, adequate time for taking up the follow-up action after registration.

• This also enriches the applicant to strongly bargain with its potential business environment components such as investors, manufacturers or contractors as they do not have any other person for the same thing. It gives quite a lot of monopoly power to the individual.

• As one has around twelve months, enduring steps towards developing, manufacturing or seeking licensees and backers has to be taken.

• This gives a right which notifies others that this idea has been already patented and hence the applicant can use ‘Patent Pending’ along with this invention or innovation or idea.

• The most important, one can promote the ideas without the fear of forgery or theft as no one can copy it.
