Legislation of US Immigration: Naturalization Act of 1790

First Naturalization act was passed on March 26, 1790(1 Stat. 103), provided they are free, white, alien who resided in United States for a period of 2 years was eligible for citizenship. This act will allow Alien to apply for citizenship, if he/she resided for the term of one year at least. An individual who desire to become one shall apply to any common law court in state where he resided for 1 year at least.

US Citizenship shall be granted for those individual who prove to the court’s satisfaction ‘good moral character’ and took oath of allegiance to the Constitution. Children of the successful applicants, under 21 years of age, they will automatically become citizens.

On January 29, 1795(1 Stat. 414), the residence period got increased from 2 years to 5 years. Applicant should declare their intention of becoming United State resident publicly and also renounce any allegiance to foreign prince 3 years before admission as citizens. These actions need to be taken before the supreme or district court of any state of United States.

Congress passed an act (2 Stat. 153), on April 14, 1802 that gave clerks of the court, the direction to record the entry of all aliens into United States. Information including applicant’s name, birth place, age, country of emigration, and granted each applicant a certificate as evidence during the time of arrival into United States.

Another act for 19th century on June 27, 1906(34 Stat. 596), which changed Immigration Bureau to Bureau of Immigration and Naturalization. This team will be in charge of the all aliens Naturalization matters. Under this act 1906, each Naturalization case to be examined by Bureau officials.

On May 9, 1918 act (40 Stat. 542) given a privilege to member of armed forces, who had worked for 3 years or more can become US Citizen without proof of 5 years residency requirement. Another advantage for the members, who serviced during the World War I, will be exempted from requirement to file declaration of Intention to become US Citizen.

Before the Act (42 Stat. 1021), women married to US Citizen automatically used to get US Citizenship. But this new act requires woman married after the date of enactment who desires to become citizen, must meet the Naturalization laws. The new law requires, period of residence of 1 year not 5 years and declaration of intention was not necessary.
