Subdivision of your property – the process and its worth to time and cost

By Adley Sone Subscribe to RSS | July 26th 2012 | Views:

Property subdivision is when the land gets divided and separate lawful unit is set up for each of the new sections that are made. A break up title is created by the District Land Registrar that issues a certificate of title after getting an application and a subdivision plan. There are several reasons why you may think of sub-dividing your property. It may be that your residence is too big according to your requirement or you own a farm that needs to be subdivided for your own benefit.

The property subdivision is managed and controlled by a number of Acts among which the most important is the Resource Management Act of 1991. This Act brought subdivision and planning controls under one system. The effect of the Act is to forbid all subdivisions unless they are particularly allowed by a rule in a District Plan or resource consent.

Property subdivision – What is the process?

If you are thinking to subdivide your property, you should seek advice of an experienced lawyer. He should be able to examine if subdivision is allowed in your property and whether or not it is reasonable. This will engage looking for the lawful title to your property and examining the District Plan that may be applicable for your property.

You need to know that the property subdivision process is long. However, the following is a general idea of the possible steps:

getting hold of a resource approval from your local council

lodging the subdivision plan

organizing a survey plan

the closing of your plan by your local council

the acceptance of the plan

Subdividing your property – Is it worth the cost and time?

If you want to subdivide your property, you should give proper attention to the time and cost factor. It is obvious that the process will be extended by the unnecessary interruptions that are being caused. For example, any hearing needed before dividing the property, the need to get approval from the council, the need to finish particular work so that you may obey with the conditions that are enforced and the formation of the lawful documents.

It is also expensive to subdivide your property. The costs that you’ll possibly have to pay consist of the fees that are charged by the consultants, the local council, the surveyors, the engineers and the lawyer. You need to know that town planning is the anticipation of the future requirements of a built up area so that the population can remain happy, healthy and safe. This means that a great deal of research work should be done so that every feature of built up area can be observed properly.

If you’re depending on the progress of selling the subdivided property to fund the venture, you need to be aware that it may take some time before you get the money. Various costs will have to be paid at the different stages and it is not likely that you will be able to postpone paying them. In addition, it is unlikely that a lender will be ready to treat probable profits as enough security for borrowing that may be needed.
