Being a landlord, letting property to rent in Edinburgh is a great financial step but at the same time it is important that you must be aware of landlord responsibilities and your legal rights. Before you can let property to rent in Edinburgh, law requires you to register with your local authority as a private landlord. Once this is done, only then you can have the financial gains of letting property.

Tenancy agreement

In Scotland, whenever you enter into a tenancy agreement, it is by law an assured shorthold tenancy, unless you agree otherwise. The length of this tenancy agreement depends on the landlord and tenant of the respective property. It can be agreed for a set period of time, which is known as fixed term or it can be left open ended. The landlord can even end the tenancy period after six months without giving a reason for it. However, for this, the fixed term agreed between the parties should have been ended and a two months written notice must be given to the tenant.

Responsibilities of a landlord

Whether you are letting a Edinburgh flats to rent or any other kind of Edinburgh property, you will have certain responsibilities. These include primarily the maintenance and repairs of the property. This will include the exterior, interior, structure, heating, installations etc.

You must also ensure that all the electrical systems and appliances in the property to rent in Edinburgh are safe for use. The furniture and fittings supplied with the property to rent in Edinburgh should be in compliance with the Furniture and Furnishing Regulation 1988. Moreover you must keep a record of safety checks and also provide these to the occupier.

Multiple occupation in Edinburgh

As a landlord you will also require a Houses in Multiple Occupation license (HMO), if you are going to let Edinburgh property to more than three tenants. This is usually required by landlords who intend to rent their Edinburgh flats to rent or their house to students.
