The government of Scotland, Edinburgh has facilitated letting for people. The rights and responsibilities of landlords and tenants are given legal protection.

Hence, it is extremely important that both the parties enter into a written agreement, detailing their duties and responsibilities. As a tenant or lodger you must also get the landlord to stipulate a reasonable notice period and contain other useful terms in order to have a proper start. This tenancy agreement will cover all details, like, rent, method of payment, deposit, paying bills and utilities, keeping furnishings in a good condition, maintenance and repair of the property.

All the duties, responsibilities and obligations of the tenant will be detailed in the tenancy agreement. Failure on his part to adhere to these can result in deposit being withheld (all or part of it) or legal action pursued against him.

Typical responsibilities of a tenant

First and foremost, the tenant must the rent and all the other utilities and bills during the term of the tenancy and on date. In most cases this might also include the water rates and the council tax. If any service is disconnected due to non-payment on his part then the tenant must bear the costs of reconnecting services. He must also pay the television license fee.

The tenant must ensure that the property is secure at all times. He must be careful in keeping the doors and windows locked. If the property is damaged in any way then he must inform this to the landlord so that repairs can be carried out. Delay on his part can cause a further damage and the tenant will be responsible for this.

If there is a ban on pets and animals then that must be adhered to by the tenant. He must not be a source of nuisance to the neighbors.

He must keep the property in good conditions and try and maintain its condition. If there is a garden, then that must be cleaned as well. Also, he must not carry out any alterations without seeking permission from the landlord. He must allow the landlord to inspect the property at a reasonable notice.

The tenant cannot sub-let or brings in other lodgers until and unless the landlord agrees to it.

Also, the law does not allow the tenant to use property for business purposes or carry any illegal activity.
