Legal Rights and Duties of a Tenant when Renting Property in Edinburgh; Administrative Process and Agreement
Once you have found the right property, the next step is to secure it properly by understanding your rights and obligations as a tenant.
If you have made up your mind regarding a particular property then you should pay the deposit to the landlord or estate agent. This step will remove the property off the market.
Payment of the holding deposit will take you to the next step, which is the administrative process. If you are renting a property via an agent then you will have to pay an administration fee and also allow permission to research whether you are a suitable tenant and capable of paying rent. For this purpose you will have to provide references of your previous landlords, bank details and credit check along with the reference of your employer. The landlord will want all this information to ensure that the tenant has a history of paying bills and is still capable of doing so. In addition, you might also have to provide a guarantor (especially for students), who will be responsible to pay the rents in case you are unable to do so.
This is mostly 1-2 months of rent and is security for the landlord in case you cause damage to his property. Legally, tenants will get their deposit back if they keep the property in good condition.
Preparing an inventory
This is basically a list of all the items that your property contains and their condition. This is prepared either by the landlord or the letting agent. It is important that you pay full attention to this as the amount of deposit you will get back depends on this list. You should visit the property with the landlord or the agent and agree to the state of every item. Taking photos will further put you at a safe position.
The tenancy agreement
This is the final written agreement between you and the landlord. This document will outline the duties and responsibilities of both the parties, commencement date of the tenancy, duration of the tenancy, the agreed rent and the notice period which has to be given by either party in case they want to terminate the contract.
Moving in your new home
You should be very careful with packing your stuff. There are now companies which provide this service for you. They bring in the boxes, pack the stuff, get them transferred and even set it according to the details provided them.
